Diecast Garage is operated by DCG Labs Inc., an Ontario corporation (“we”, “us”). These terms are an agreement between you and DCG Labs Inc. They cover the Diecast Garage apps for iPhone and Android, the web app at app.diecastgarage.ca, the website at diecastgarage.ca, public share pages, and any related service we provide (together, the “service”). By creating an account or using the service, you agree to these terms. How we handle personal information is explained in our privacy policy.
You must be at least 13 years old. If you are under the age of majority where you live, you need a parent or guardian’s permission to use the service, and you may buy, sell, trade or make purchases only with their involvement. You need an account for most features, created with an email address and password or with Google or Apple. Give accurate information, keep your sign-in details to yourself, and tell us if you think someone else has used your account. You are responsible for activity under your account.
Diecast Garage is a collection app for die-cast car collectors: AI-assisted recognition, a shared casting catalog, community-powered value estimates, research, posters, sharing, a release radar and show calendar, a community of collectors, and a collector marketplace. We keep improving it, which means features can be added, changed, limited or removed. Some features are labelled beta, preview or test, may be offered to some collectors before others, and may not work perfectly. We aim to keep the service available but can’t promise it will be uninterrupted or error-free.
Photos, notes, listings, messages, reviews and collection data you add (“your content”) stay yours. So we can run the service, you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, adapt (for example resize or crop) and display your content, for as long as it is in the service, and only to operate, secure and improve Diecast Garage and to show it where your settings or actions make it visible.
Some contributions become part of the shared catalog: a photo of a casting that has no catalog image yet, and catalog facts or corrections you submit. For those, the licence is also perpetual and irrevocable, may be sublicensed to our service providers, and survives deletion of your account, with your name removed. Personal fields (what you paid, where you bought, your notes) are never part of the catalog and never appear on any public surface. The privacy policy explains what others can see.
You confirm you have the right to post your content and that it doesn’t break the law or anyone’s rights. If you send us ideas or feedback, we may use them freely without owing you anything.
We use information about how the service is used to run, secure and improve it, as described in the privacy policy. Optional analytics, session recordings, heatmaps, marketing measurement and marketing messages depend on the choices you make there, not on accepting these terms. We own aggregated or de-identified data and insights we create from the service, which can’t reasonably identify you, and may use and share them for any lawful purpose, including reports, partnerships and research.
Recognition, research, photo checks, import mapping and posters use AI. AI output can be wrong, incomplete or unexpected: check an identification before relying on it, and don’t treat research as verified fact. Posters are generated images for your personal, non-commercial use; they may not look exactly like your car, and brand names and logos shown on them belong to their owners.
Value figures come from market listings and community-logged sales, filtered statistically. They are estimates for hobby purposes: not appraisals, not insurance valuations, not financial advice, and not a promise a car will sell at any price.
Listings, offers, trades and sales are arranged between collectors. Unless we clearly say otherwise for a particular feature, DCG Labs Inc. is not a party to any transaction, doesn’t hold funds, and doesn’t inspect, authenticate or guarantee items or collectors. If we offer payment, invoicing or auction tools, payments are processed by a third-party payment provider under its own terms, and any fee we charge is shown before you commit.
The core app is free, and we don’t sell subscriptions. We may offer optional one-time purchases, such as research Fuel or extra garage capacity. Prices are shown before you buy. Purchases made through the App Store or Google Play are also governed by Apple’s or Google’s terms, and refunds for them are requested from Apple or Google.
Fuel and other in-app items are a limited, non-transferable licence to use features of the service. They have no cash value, can’t be exchanged for money, and can’t be sold or transferred. The free monthly Fuel allowance tops your tank up to a set level and doesn’t accumulate; purchased Fuel doesn’t expire while your account exists. Once used, purchases are not refundable except where the law or the store’s policy requires. Nothing in this section limits rights you have under consumer protection law.
Some links to retailers and marketplaces, such as eBay, are affiliate links: we may earn a commission if you buy, at no extra cost to you. We disclose these where they appear. We may also feature partners, sponsored placements or promotions, and we label paid placements as such. Third-party sites and offers are governed by their own terms, and we aren’t responsible for them.
We send service messages you need, such as security notices, marketplace notifications you haven’t turned off, and changes to these terms. Marketing messages go only to people who agreed to receive them, and you can unsubscribe at any time.
You can stop using the service and delete your account at any time from the app’s settings. We may remove content, limit features or suspend or close an account that breaks these terms, puts others at risk, or where the law requires, and we’ll tell you why unless the law or safety prevents it. Suspension restricts what an account can do, never its owner’s right to export or delete their data. Sections that by their nature should survive, such as the catalog licence, disclaimers, liability and governing law, survive the end of this agreement.
The service, including its software, design, the Diecast Garage name and logo, and the compiled catalog, belongs to DCG Labs Inc. and its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the apps on devices you own or control, under these terms. Casting facts sourced from community wikis carry their attribution (CC BY-SA) where shown. Hot Wheels, Matchbox and every other brand belong to their owners. Diecast Garage is an independent collector tool, not affiliated with or endorsed by any toy maker or car maker. If you believe content on the service infringes your rights, write to info@diecastgarage.ca.
If you got the app from the App Store or Google Play: these terms are between you and DCG Labs Inc., not Apple or Google, and we, not they, are responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent the law allows, Apple has no other warranty obligation. Apple is not responsible for addressing claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone’s intellectual property; we are responsible for those to the extent these terms say so. You confirm you are not in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also follow the store’s own usage rules.
To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, including that it will be accurate, uninterrupted or fit for a particular purpose. Recognition, research, catalog data and values can contain errors. Some jurisdictions don’t allow these exclusions, so some may not apply to you.
To the extent the law allows, DCG Labs Inc. and its directors, employees and contractors are not liable for indirect, incidental, special or consequential losses, lost profits or lost data, or for the acts of other collectors or third parties, and our total liability for any claim about the service is limited to the greater of what you paid us in the twelve months before the claim or CA$100. Nothing in these terms limits liability that can’t be limited by law, including for fraud, intentional or grossly negligent conduct, or rights you have under consumer protection law.
To the extent the law allows, and except where you are protected as a consumer, you will cover our reasonable losses and costs from claims by others caused by your content, your listings or deals, or your breach of these terms.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Before starting a formal claim, please write to info@diecastgarage.ca so we can try to resolve it; most problems are settled that way within 30 days. If not, the courts of Ontario have jurisdiction. If you are a consumer living elsewhere in Canada, you keep the protection of the consumer laws of your province and may bring a claim in your local courts where those laws allow.
We may update these terms as the service changes. We’ll post the new version here with its date, and give notice in the app before a material change takes effect. If you don’t agree, you can stop using the service and delete your account; continuing to use it after the change takes effect means you accept it.
These terms and the privacy policy are the whole agreement between you and us about the service. If a part is found unenforceable, the rest still applies. Not enforcing a term right away doesn’t waive it. You may not transfer these terms; we may transfer them to a successor to the service, with notice to you. These terms were written in English.
